MINUTES OF THE PUBLIC MEETING OF JANUARY 11, 2011
TOWN HALL, 542 LIBERTY STREET, HANSON, MA

Called to Order at 7:30 PM under M.G.L. c 131, §40 and the Hanson By-Law 3-13, §5 and Rules and Regulations by Frank Schellenger, Vice Chairman, in Meeting Room A at the Town Hall.

Public Hearings

7:30 PM Continued Notice of Intent for a proposal to control aquatic nuisance vegetation by the Town of Halifax to treat the algae in the eastern and western basins of Monponsett Pond utilizing low-dose treatments of aluminum sulfate (alum), to preclude severe algae blooms and to lessen the likelihood of toxic algae blooms  (DEP #SE175-0580)

Request for an Amendment to a Proposed Septic System #4 (Builders Lot 9A) Fawn Lane (DEP #SE175-0532)    

Mr. Jay Gallagher of J.P. Gallagher Construction and Development submitted a new plan dated 12/20/10, prepared by CCR Associates, Inc..  He explained that the scope of work has remained the same but the configuration of the house is different.  Mr. Vacca stipulated that the original permit approved a variance to install the erosion control within the 50’ buffer zone so as to allow heavy machinery to get around the construction of the foundation.  He suggested that Mr. Gallagher revise the haybale line to it’s original placement to achieve this.  Mr. Gallagher agreed and said that in addition he would slide the house 2 to 3 feet forward to provide sufficient room for construction.  He also requested to extend a deck out 4 feet.   Mr. Vacca said that because all work is within the original building pocket, this request should be treated as a “Minor Correction”.

Town Report
The Commission commended Mr. Schellenger for a well written report and thanked him for his efforts.

By-Law Fees
Mr. Vacca informed the Commission that the Selectmen met last week to review the revisions to the By-Law fees.  Because staff could not attend the meeting and the Selectmen had questions, they were not approved.  Mr. Vacca met with Mr. Rene Read, Town Administrator the following day who requested more data from surrounding towns.  Ms. Nehiley provided this additional data.

8:00 PM  Request for Determination of Applicability for the construction of a driveway within 100 feet of a Bordering Vegetated Wetland at 101 Pratt Place, Map 89, Lot 2 for Bank of America, as Trustee represented by H, S & T Group, Inc., 75 Hammond Street, Worcester, MA  01610

John Kemmett read the Public Hearing Notice.  Because proof of abutter notification was not submitted as required, the Commission allowed the hearing to be heard, but any approval would be pending said proof.  Ms. Crystal Carr of H, S & T Group submitted a conservation site plan dated 12/3/10 depicting the relocation of a driveway because the present one encroached onto the abutting property at 90 Pratt Place.  Ms. Carr explained that the impervious surface would be reduced by 300 square feet and the old asphalt would be removed offsite.

Executive Session

8:03 PM  Mr. Lindquist asked for a motion to go into executive session under Massachusetts General Laws, Chapter 39, Section 23B (3) to discuss strategies with respect to pending land acquisition because a public discussion of these strategies will have a detrimental effect on the negotiating position of the Town of Hanson through the Conservation Commission.

A Roll Call vote was taken and each member was in favor.  

8:47 PM, the Commission voted unanimously to come back into public session.  It was announced no votes were taken during executive session.
